1. About Nuvella

Nuvella is a salon management platform that helps salons manage appointments, services, professionals, clients, and related business operations.

Nuvella may provide different types of access, including:

• public website access;
• public salon booking pages;
• customer appointment areas;
• salon admin accounts;
• subscription-based salon management features.

2. Eligibility

To use Nuvella, you must be legally able to enter into agreements under the laws applicable to you.

If you use Nuvella on behalf of a salon, company, or other organization, you confirm that you have authority to accept these Terms on behalf of that organization.

3. Account Registration

Some parts of Nuvella may require an account.

When creating an account, you agree to provide accurate, current, and complete information. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

You must notify us immediately if you believe your account has been accessed without authorization.

4. Google Login and Third-Party Authentication

Nuvella may allow users to register or sign in using third-party authentication providers, such as Google.

By using a third-party login option, you authorize Nuvella to receive basic account information from that provider, such as your name and email address, according to the permissions you approve.

Nuvella is not responsible for the availability, security, or policies of third-party authentication providers.

5. Appointments and Bookings

Nuvella may allow clients to request or schedule appointments with salons through public booking pages.

Appointment availability, services, professionals, prices, cancellation rules, and confirmation requirements are managed by each salon.

Nuvella provides the technology used to facilitate bookings, but the salon is responsible for delivering the selected service and managing its own business policies.

6. Cancellations

Users may be able to cancel upcoming appointments through the platform when this option is available.

Cancellation rules may vary depending on the salon. Some appointments may be subject to cancellation fees, late cancellation policies, or no-show policies established by the salon.

Nuvella is not responsible for disputes between clients and salons regarding cancellation rules, fees, refunds, or service delivery.

7. Subscriptions and Payments

Some Nuvella features may require a paid subscription.

Subscription plans, prices, billing cycles, trial periods, and included features may be displayed on our website or inside the platform.

By subscribing to a paid plan, you authorize Nuvella or its payment provider to charge the applicable fees according to the selected plan.

Prices may change from time to time. If pricing changes affect your active subscription, we will make reasonable efforts to notify you before the change takes effect.

8. Free Trials

Nuvella may offer free trials for certain plans.

At the end of a free trial, your access may be limited or converted into a paid subscription, depending on the terms displayed when you start the trial.

You are responsible for reviewing the trial terms before subscribing.

9. Acceptable Use

You agree not to use Nuvella to:

• violate any applicable law or regulation;
• create fake, misleading, or fraudulent accounts;
• submit false appointment requests;
• attempt to access accounts, systems, or data without authorization;
• interfere with the security, availability, or performance of the platform;
• upload or transmit malicious code, spam, or harmful content;
• abuse, harass, threaten, or harm other users, clients, salons, or professionals;
• copy, resell, or exploit Nuvella without authorization.

We may suspend or terminate access if we believe these rules have been violated.

10. User Content and Business Data

You may submit information to Nuvella, including salon details, services, appointment information, client details, and other business data.

You remain responsible for the accuracy, legality, and ownership of the information you provide.

By using Nuvella, you grant us permission to process and store this information as necessary to operate, maintain, secure, and improve the platform.

11. Privacy

Your use of Nuvella is also subject to our Privacy Policy.

The Privacy Policy explains how we collect, use, store, and protect personal information.

By using Nuvella, you acknowledge that you have read and understood our Privacy Policy.

12. Service Availability

We aim to keep Nuvella available and reliable, but we do not guarantee uninterrupted or error-free service.

The platform may be temporarily unavailable due to maintenance, updates, technical issues, third-party provider failures, or events beyond our control.

13. Changes to the Platform

We may update, modify, suspend, or discontinue any part of Nuvella at any time.

We may also add, remove, or change features as the product evolves.

14. Intellectual Property

Nuvella, including its name, brand, design, software, interface, logos, content, and related materials, belongs to Nuvella or its licensors.

You may not copy, reproduce, distribute, modify, reverse engineer, or create derivative works from Nuvella without prior written permission.

15. Third-Party Services

Nuvella may integrate with third-party services, including payment processors, authentication providers, email providers, analytics tools, hosting providers, and other business tools.

We are not responsible for the availability, actions, policies, or content of third-party services.

Your use of third-party services may be subject to their own terms and policies.

16. Disclaimer

Nuvella is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, we do not make warranties that the platform will always be available, secure, error-free, or suitable for every business need.

Each salon is responsible for managing its own appointments, services, prices, professionals, clients, and business operations.

17. Limitation of Liability

To the maximum extent permitted by law, Nuvella will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of business, loss of data, service interruptions, or disputes between salons and clients.

Our total liability for any claim related to the use of Nuvella will be limited to the amount paid by you to Nuvella in the three months before the claim, or CAD $100 if no payment was made.

18. Account Suspension or Termination

We may suspend or terminate your account if:

• you violate these Terms;
• you misuse the platform;
• payment fails for a paid subscription;
• we detect suspicious, fraudulent, or harmful activity;
• we are required to do so by law.

You may also stop using Nuvella at any time.

19. Account Cancellation

If account cancellation is available in your account settings, you may request cancellation through the platform.

Some information may be retained as required for legal, security, billing, fraud prevention, or legitimate business purposes.

20. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the "Last updated" date at the top of this page. Continued use of Nuvella after changes means you accept the updated Terms.
